Die folgende Arbeit liefert eine Einschätzung zur Lage des rights- based development Ansatzes und der dem Ansatz zu Grunde liegenden wirtschaftlich, sozialen und kulturellen Rechte innerhalb von Österreich. Die Anwendbarkeit dieses neuerdings en vogue geratenen Entwicklungsansatzes in Österreich wird dabei in Bezug zur Rechtslage in Südafrika gesetzt. Insbesondere Südafrika gilt durch zwei richtungsweisende Urteile TAC und Grootboom des Verfassungsgerichtshofs als eine Art Vorreiter auf diesem Gebiet. Diese Urteile bejahen erstmals eine Justiziabilität der wirtschaftlichen, sozialen und kulturellen Rechte und rücken diese, vormals als unvollendete Menschenrechte bezeichneten Rechte, in ein neues Licht. Sie begründen auch sozialstaatliche Verpflichtungen. Unter diese sozialstaatliche Verpflichtung fällt etwa das Recht auf Wohnen, das Recht auf Gesundheitsvorsorge oder auch das Recht auf Schulbildung. Jeder in Südafrika lebende Mensch (Staatsbürgerschaft oder legaler Aufenthaltstitel sind dabei keine Voraussetzung), muss einen gleichwertigen Zugang zu diesen Rechten haben. Gänzlich differenziert gestaltet sich die Rechtslage in Österreich. Es existieren keine Entscheidungen des Verfassungsgerichtshofes zu den wirtschaftlichen, sozialen und kulturellen Rechten- sie stellen verfassungsrechtlich auch keine Grundrechte dar.

The following work provides an assessment of the situation of the rights-based development approach and the approach underlying economic, social and cultural rights within Austria. The applicability of this recently in vogue more advisable approach to development in Austria, is set here in relation to the legal situation in South Africa. In particular, South Africa is through two landmark judgments TAC and Grootboom the Supreme Court as a kind of pioneer in this field. These rulings affirm the first time a justiciability of economic, social and cultural rights, and bring these formerly as unfinished human rights, the rights in a new light. They also justify welfare-state obligations. Under this welfare state commitment is about the right to housing, the right to health care or the right to education. Each person living in South Africa (citizenship or legal residence permits are not required), must provide equal access to these rights are. Completely differentiates itself shapes the legal situation in Austria. There are no decisions of the Supreme Court on the economic, social and cultural rights in Austria, because they’re not part of Austrian’s Constitution.
The main aim of this paper is to provide essential theoretical framework, which properly depicts the rights based development approach within its international focus. It is therefore important to depict every single social human right and to show different approaches on the rights based development field. Within in the empirical part of this Master Thesis the author interviewed representatives of different Think Tanks and authorities for supporting the mainly theoretical arguments with empirical material. Furthermore five different papers which comment on the South African judgments TAC and Grootboom were use to get proper empirical material to South Africa and its social human rights. This empirical material compares with assistance of three research questions and nine hypotheses the different situation of those economic, social and cultural rights in Austria and South Africa.
