Die vorliegende Arbeit befasst sich mit dem Feld der Beratung von AsylwerberInnen in Österreich. Dabei wird die Frage gestellt, warum das Bundesministerium für Inneres (BMI) für die Rechts-, Rückkehrberatung und Schubhaftbetreuung von AsylwerberInnen vorrangig den Verein Menschenrechte Österreich einsetzt und andere unabhängige Flüchtlings-NGOs Projektfinanzierungen in diesen Bereichen verlieren. Außerdem wird den Behauptungen von Flüchtlings-NGOs, der Verein Menschenrechte Österreich könne nicht unabhängig agieren, da es sich dabei um eine Government-Organized Non Governmental Organisation handle, nachgegangen. Mit Hilfe einer Dokumenten- und Literaturanalyse und unter der Verwendung von Indikatoren einerseits aus der wissenschaftlichen Literatur und andererseits aus einem „Punkterasters“ des BMIs zur Auswahl von Projekten wurde versucht diese Fragen zu beantworten. Dabei gibt das Material Hinweise darauf, dass es zwischen dem Verein Menschenrechte Österreich und dem Innenministerium eine enge Kooperation gibt und dies dazu führt, dass der Verein Menschenrechte Österreich nicht losgelöst von den Interessen des BMI arbeitet, was Auswirkungen auf die Beratung von AsylwerberInnen hat.

The topic of this paper deals with the advice given to asylum seekers in Austria. The question is raised why the Ministry of the Interior (BMI) prefers to entrust the Verein Menschenrechte Österreich (VMÖ = Association of Human Rights Austria) with giving legal advice, voluntary return and custody pending deportation assistance to asylum seekers and why other NGOs thus lose project financing in these areas. Central to this thesis is whether, according to the claims of refugee NGOs, the VMÖ is a government-organized non-governmental organization (GONGO) and if a GONGO is able to maintain independence from interests of political authorities when giving legal advice to asylum seekers. In order to answer these questions, relevant documents and literature have been ana- lysed. Indicators from the scientific literature on the one hand and from a point system for the selection of projects from the BMI on the other hand were used to facilitate the analysis. This material gives evidence that there is close co-operation between the Verein Menschenrechte Österreich and the Ministry of the Interior, implying that the VMÖ works in the interests of the BMI and that this has an impact on the counselling of asylum seekers.
