Der aktuelle konjunkturelle Verfall in Europa lenkt zwangsläufig die Aufmerksamkeit der wirtschaftlichen Praxis auf die rechtlichen Regelungen der Unternehmens-fortführung als ein Instrument der Krisenbekämpfung.
Auch ich habe in dieser Arbeit versucht die besondere Situation des Unternehmens-fortbestands in der Insolvenz zu untersuchen, mit einem Fokus auf die slowakische Gesetzgebung.
Um dieses Ziel zu erfüllen stellte ich kurz das US-amerikanische und das österreichische Sanierungsverfahren, auf dem Hintergrund ihrer Entwicklung vor. Folglich wurde ebenfalls die slowakische Version, das Restrukturierungsverfahren, dargestellt. Alle drei theoretischen Ansätze wurden zusätzlich mit ihrer aktuellen statistischen Entwicklung konfrontiert.
Da die rechtlichen Regelungen der Unternehmensfortführung fast ausschließlich die juristischen Vorgaben beinhalten, versuchte ich im 3. Kapitel wird die Sanierung aus der betriebswirtschaftlichen Perspektive betrachten und die Vorgangsweise bei der Zusammenstellung eines Sanierungskonzeptes darzustellen.
Das 4.Kapitel beschreibt ein erfolgreiches Restrukturierungsverfahren in der Insolvenz aus der Slowakei, welches auf die Praxistauglichkeit der gesetzlichen Vorlage hinweist.
Eine genauere Untersuchung und Verbesserungsvorschläge zum slowakischen Restrukturierungsverfahren sind im 5.Kapitel festgehalten.

The current economic situations development draws the attention to all the possible ways how to deal with the crisis. One of the relevant instruments is the insolvency law with its possibility to restructure the companies who are in distress.
In this thesis I tried to examine the complex situation how to secure the existence of a company according to the regulations of the restructuring law. While doing so I focused on the situation in Slovakia, whether it possesses any regulations on going concern principle and if so, how have these been accepted by the wide economic public.
To do so, I decided to demonstrate first the two well-established restructuring proceedings in USA and in Austria– based on each special history and evolution. Accordingly I presented also the Slovak version of such proceeding. For all three systems I gathered the statistical reference in order to evaluate, how the practice refers to the presented juridical theory.
In the third chapter my aim was to present a general going concern approach from an economic perspective, as there are no such regulations in the juridical regulations.
The fourth chapter focuses on a case study from Slovakia, where a well-known building company SIBAMAC, a.s. got in financial distress. The company’s management has successfully saved the enterprise from bankruptcy by making use of the restructuring instruments of the Slovak insolvency law.
Finally, the fifth chapter is dedicated to the evaluation of the findings. Although in general it is not easy to say which proceeding is better or worse, I came to the conclusion, that despite some shortcomings, the Slovak restructuring can be used as an efficient and effective going concern instrument and help the companies to overcome the distress situations.
