Die Besatzung des deutschen humanitären Frachtschiffs Cap Anamur, das 2004 im Mittelmeer 37 afrikanische Bootsflüchtlinge aus Seenot gerettet hatte und nach Italien bringen wollte, wurde dafür von den italienischen Behörden wegen Schlepperei vor Gericht gestellt. Die vorliegende Arbeit zum Thema italienische Einwanderungspolitik mit dem Schwerpunkt Flüchtlinge und Seemigration hat es sich zum Ziel gesetzt, die Hintergründe zum Fall Cap Anamur darzustellen und anhand dieses konkreten Beispiels die Problematik der in Italien anlandenden Bootsflüchtlinge zu erarbeiten. Zu diesem Zweck werden die diesbezügliche Rechtsperspektive auf EU-Ebene, die wichtigsten Instrumente des internationalen Flüchtlingsschutzes und das internationale Seenotrettungsrecht behandelt. Weiters werden die Eckpfeiler der entsprechenden italienischen Gesetzgebung dargestellt, sowie die umstrittenen Rücknahmeabkommen mit Libyen und die Praxis der Rückschiebung von Bootsflüchtlingen auf hoher See besprochen. Als elementar läßt sich bei diesen 'Push-Back' Aktionen der klare Verstoß gegen das in der Genfer Flüchtlingskonvention festgelegte 'Non-Refoulement' Prinzip (Zurückweisungs-verbot) erkennen, da bei Asylsuchenden in diesem Fall eine Einzelprüfung des jeweiligen Flüchtlingsstatus nicht möglich ist. Außerdem wird festgestellt, daß es in Italien wiederholt zu Fällen kommt, in denen die Retter von Bootsflüchtlingen vermutlich aus Gründen der Abschreckung strafrechtlich verfolgt werden. Abschluß der Arbeit stellt die durch die Flüchtlingstragödie vom 3.10.2013 bei Lampedusa ausgelöste aktuelle Diskussion zur italienischen und europäischen Flüchtlings- bzw. Asylproblematik dar.

The crew of the German humanitarian cargo vessel Cap Anamur, who had saved 37 African refugees in distress in the Mediterranean Sea in 2004 and later tried to bring them to shore in Italy, was arrested by the Italian authorities and put on trial for aiding illegal immigrants. This thesis about Italian immigration politics with a primary focus on refugees and sea migration strives to present the background of the Cap Anamur case and examine the complex situation of boat people landing in Italy. The topics that shall be discussed to this end are the relevant legal perspective at a European level, the most important international tools for the protection of refugees and international laws regulating sea rescue and maritime distress, as well as the cornerstones of pertinent Italian legislation, the controversial repatriation agreement with Libya and the policy of pushing-back boat people in the Mediterranean. The push-back policy at sea is a clear violation of the principle of 'non-refoulement' (the prohibition of returning refugees) established by the Convention relating to the Status of Refugees, as it would be impossible in this case to verify the individual status of asylum seekers. Furthermore, in Italy rescuers of boat people are repeatedly faced with criminal proceedings, a policy presumably implemented as a deterrent. The thesis concludes with a discussion of the current debate about the challenging issues regarding refugees and asylum seekers in Italy and Europe triggered by the tragedy near the island of Lampedusa on 3.10.2013.
