Die Masterarbeit untersucht die Rolle des Europarates als internationaler Akteur im georgisch-russischen Konflikt im Jahr 2008 in Abchasien und Süd-Ossetien. Die Ziele dabei sind die Bewertung der Hintergründe der Konflikte in diesen zwei georgischen Regionen, die Analyse der Handlungen der verschiedenen Europarats-AkteurInnen innerhalb der ersten sechs Monate nach dem Fünf-Tages-Krieg und die Bewertung der Charakteristika des Europarats als internationaler Akteur während dieser Phase. Eine Analyse der Europaratsdokumente, Sekundärquellen sowie ExpertInneninterviews mit (Stellvertretenden) Mitgliedern der Parlamentarischen Versammlung des Europarats und mit dem georgischen Botschafter in Österreich wurden durchgeführt.
Obwohl Russland Abchasien und Süd-Ossetien im Jahr 2008 als unabhängige, souveräne Staaten anerkannt hat, wird in dieser Masterthese der Schluss gezogen, dass keines von Krasner’s (1999) vier Souveränitätskonzepten für diese zwei Regionen zutrifft. Denn alle wesentlichen staatlichen Befugnisse und Kontrollfunktionen werden in Abchasien und Süd-Ossetien von der Russischen Föderation ausgeführt oder unterstützt. Die Auseinandersetzung im Südkaukasus, die zu zwei Kriegen während der 1990er Jahre und dem Fünf-Tages-Krieg im Jahr 2008 führten, waren stets territoriale - und nicht religiöse oder ethnische – Konflikte. Die Intensivierung dieser Konflikte zwischen Georgien und den zwei Regionen fand nach dem Auseinanderbrechen der Sowjetunion statt.
Der Europarat bestätigte im Zuge des Fünf-Tages-Krieg seine Rolle als internationaler Krisenakteur, speziell im Zusammenhang mit der Menschenrechtsdimension. Diese intergouvernementale Organisation verurteilte den Kriegsausbruch und Verletzung von Artikel 2 und 3 der Europäischen Menschenrechtskonvention – das Recht auf Leben und Folterverbot. Beispielsweise verhandelte der Menschenrechtskommissar den Austausch von Gefangenen und Leichen. Die Kernrolle des Europarates liegt in der internationalen Kooperation mit EU, OSZE und UN. Diese Zusammenarbeit wurde nicht nur formalisiert (Austausch von Meinungen, gemeinsame Treffen). Als Reaktion des Fünf-Tages-Krieges, trainierten Europarats-MitarbeiterInnen EUMM BeobachterInnen in Menschenrechtsangelegenheiten und ein gemeinsamer Europarats-UNESCO-Workshop wurde veranstaltet, um LehrerInnen psychologisch zu schulen. Diese Masterthese zieht den Schluss, dass der Europarat als internationaler Akteur in zukünftigen Konflikten seine Kooperation mit anderen internationalen Organisationen weiter vertiefen sollte.

This master thesis assesses the role of the Council of Europe as an international actor in the Georgian-Russian conflict of 2008 over Abkhazia and South Ossetia. Its main goal is to examine the basis for the disputes in these two Georgian regions, analyse actions taken by Council of Europe actors within the first six months after the Five-day war in August 2008, and examine the characteristics of the Council of Europe as an international actor during this immediate response. An analysis of Council of Europe documents, secondary sources as well as seven expert interviews with (deputy) members of the Council of Europe and the Georgian Ambassador to Austria and the OSCE are conducted.
Although Russia recognised Abkhazia and South Ossetia as independent, sovereign states in 2008, this thesis concludes that none of Krasner’s (1999) four concepts of sovereignty can be applied to these two regions. It is argued that the main authority and control functions of Abkhazia and South Ossetia are dominated or assisted by the Russia Federation. These conflicts in the South Caucasus leading to two wars during the 1990s and the Five-day war in 2008 were always over territory and not religion or ethnicity. The tensions between Georgia and the two regions intensified after the break up of the Soviet Union.
The Council of Europe proved its role in the aftermath of the Five-day war as an international crisis actor, especially in the human rights dimension. This intergovernmental organisation condemned the outbreak of the war and violation of Articles 2 and 3 of the European Convention of Human Rights, namely the right to life and prohibition of torture. The Commissioner for Human Rights, for instance, negotiated hundreds of exchanges of prisoners and corpses. The key role of the Council of Europe lies in the co-operation with other international organisation such as the EU, OSCE and UN. This relationship was not only been formalized (exchange of views, joint meetings). In the aftermath of the Five-day war, the Council of Europe staff trained EUMM observers on human rights issues and a workshop to instruct teachers on supporting children psychologically was jointly organised by the Council of Europe and UNESCO. This thesis concludes that the Council of Europe as an international actor in future conflicts could further intensify active co-operation with other international organisations.
