Die vorliegende Arbeit behandelt die Entwicklung des subsidiären Schutzes als Teilharmonisierung des komplementären Schutzes in der Europäischen Union nach dem Vertrag von Amsterdam. Aufbauend auf einer Analyse des internationalen Schutzdiskurses im Nachkriegseuropa zentriert die Arbeit auf eine kritische Diskursanalyse der Arbeit des Europäischen Rates und speziell der Arbeitsgruppe für Asyl bis zur Unterzeichnung der ersten Statusrichtlinie 2004. Die Arbeit zeigt, wie einige Mitgliedsstaaten die ursprünglichen Pläne der Kommission weitgehend untergruben und so die Harmonisierung in weiten Teilen verunmöglichten.

In this thesis I examined the harmonization process of the complementary protection regime in the European Union in light of the creation of the Common European Asylum System. At first I described the scope and background of the 1951 Refugee Convention to then analyse the protection gap that was created through an exclusive interpretation of the Convention in the post-war period. The development of UNHCR between 1951 and 2001 showed how the international protection discourse was transformed over the years. The centrepiece of the thesis is a detailed and critical analysis of the protection discourse during the crucial years from 1997 to 2004, when the European Council signed the first Qualification Directive. I have shown how an alliance of central and south-western European states managed to undermine the harmonization plans of the European Commission and keep many material rights of international protectees in the national policy sphere. Thereby the newly created subsidiary protection status harmonized complementary protection on the paper, but left the implementation to national discretion.
