Die historischen, rechtlichen, wirtschaftlichen und außenpolitischen Folgen/Zusammenhänge der vom UNO Sicherheitsrat verhängten Irak Sanktionen 1990-2003 sind Gegenstand dieser Masterarbeit. Die USA waren federführend im Ersten Golfkrieg und bei der Verhängung/Aufrechterhaltung dieser Sanktionen. Die Folgen für Irak und dessen zivile Bevölkerung waren verheerend – ein humanitäres Desaster. Das Öl-für-Lebensmittel-Programm war ungeeignet das Leid der Bevölkerung zu lindern und stand überdies unter Korruptionsverdacht. Die rechtlichen Grenzen gemäß Kapitel VII der UN-Charta wurden verletzt. Die Bevölkerung war schutzlos den unverhältnismäßigen und illegalen Sanktionen ausgesetzt. Gemessen an ihren Auswirkungen waren die Sanktionen ein ungerechter Krieg, für das die UNO zumindest die moralische/politische Verantwortung trägt.

This thesis analyzes the historical, legal, economic and foreign policy aspects of the US-led UNSC sanctions on Iraq from 1990 to 2003. In conjunction with the First Gulf War in 1991, these sanctions devastated and impoverished Iraq, throwing it back to a pre-industrial state. Its cities were destroyed, its population starved and its industry and economy demolished. An entire nation was intentionally made to pay for Saddam Hussein’s wrongdoings, The US-led war and sanctions against Iraq were primarily determined by the US neoconservative foreign policy objectives in the Middle East. This analysis studied UN sanctions as a policy tool and specifically as an enforcement measure under Chapter VII of the UN Charter. The UNSC does not and cannot act in a legal vacuum, but must respect certain legal boundaries which the Iraq sanctions violated. Moreover, the UN failed to meet its obligations to protect civilian populations, preventing critical humanitarian aid and relief for Iraq. UN mismanagement and corruption occurred on many levels, especially regarding its Oil-for-Food-Programme. This thesis asks and attempts to answer the questions: did the Iraq sanctions regime constitute an unjust war and was there a moral if not legal responsibility for this war? The conclusion reached is that the comprehensive 13-year-long UNSC sanctions, unprecedented for the UN, represented an unjust war, a “continuation of politics by other means”, for which the moral and political responsibility lies with those who sought, imposed, supported and implemented the Iraq sanctions regime.
