While the relationship between the United Nations and the European Union is a common topic in academic literature, the rapid evolution of the latter into a unique example of progressive integration and establishment of common institutions and binding rules for Member States has rendered somehow difficult a comprehensive approach to the topic, with particular regards to potential conflicts between the two judicial systems in certain domains such as international peace and security. The transformations occurred within the European Union and the primacy over Member States may have created, in a particular, a theoretical conflict in the attributions of certain states (France, and until recently the United Kingdom) in their roles of sovereign states within the United Nations Security Council and, at the same time, Member States participating in the shared decisions and institutions of the European Union. At present, the European Union is, globally, among the most important contributors to the UN budget and a successful partner in the conduct of peace-keeping operations, after a gradual mutual recognition of the importance of both systems in their constitutive and legislative acts. Notwithstanding the many steps, both legal and political, undertaken to ensure a profitable cooperation, a conflict of attribution may still exist in theory as well as in practice. Analysing those instances where a divergence between EU common interests and UN Security Council positions has translated into an active role of certain EU institutions possibly overstepping their authority with regards to international obligations and jus cogens. Such analysis offers a basis of discussion around the desirability, and legitimacy, of the influence of the European Union on the institutions of the United Nations as well as on the legal and political considerations animating debates on possible reforms within the United Nations, the European Union, or both.
