Der andauernde Konflikt im Gazastreifen, verschärft durch die Angriffe vom 7. Oktober, hat die kritischen Herausforderungen bei der Lieferung humanitärer Hilfe deutlich gemacht. In diesem Zusammenhang ist es grundlegend, die Vorgaben des internationalen Rechts zu diesem Thema zu prüfen. Diese Arbeit klärt die Verpflichtungen Israels und der Hamas als Parteien des Konflikts sowie der Drittstaaten hinsichtlich der Gewährung und Förderung von Hilfslieferungen, wobei der rechtliche Rahmen des Internationalen Humanitären Rechts und des Internationalen Menschenrechtsrechts analysiert wird. Durch eine kritische Analyse der Einhaltung dieser Verpflichtungen zeigt die Forschung erhebliche Eingriffe und das Fehlen legitimer Rechtfertigungen seitens der Konfliktparteien auf. Es wird vorgeschlagen, dass, obwohl die rechtlichen Rahmenbedingungen umfassend sind, ihre Anwendung inkonsistent ist, was zu schweren Folgen für die Zivilbevölkerung führt. Es wird auch darauf hingewiesen, dass Drittstaaten eine bedeutende Rolle bei der Erleichterung der Hilfe spielen und erklärt, warum Waffenstillstände allein nicht ausreichen, um die aktuellen humanitären Bedingungen zu verbessern. Die Arbeit schließt mit dem Hinweis, dass es im Krieg von entscheidender Bedeutung ist, humanitäre Bedürfnisse und militärische Notwendigkeiten auszubalancieren, um Zivilisten in hochriskanten Umgebungen wie dem Gazastreifen und dem Westjordanland zu schützen.

The ongoing conflict in Gaza, exacerbated by the 7 October attacks, has brought into sharp focus the critical challenges surrounding the delivery of humanitarian aid. In this light, it is fundamental to examine what international law dictates regarding the issue. This thesis clarifies the obligations of Israel and Hamas as parties to the conflict, as well as third states, in allowing and facilitating relief supplies, focusing on the legal scope of International Humanitarian Law and International Human Rights Law. Through a critical analysis of compliance with these obligations, the research reveals significant interferences and a lack of legitimate justification by the parties to the conflict, suggesting that while legal frameworks are comprehensive, their application is inconsistent, leading to severe consequences for the civilian population. It also points out that third states play a significant role in facilitating relief and explains why ceasefires alone are insufficient to improve current humanitarian conditions. The thesis concludes that, in conducting warfare, it is crucial to prioritize balancing humanitarian needs with military necessities to protect civilians in high-risk environments such as the Gaza Strip and the West Bank.
