Diese Masterarbeit beleuchtet ein bislang weitgehend unbeachtetes Feld der Philosophie. Sie betrachtet Sex als eine gemeinsame Handlung and untersucht die daraus resultierenden Implikationen für das Konzept des sexuellen consent. Ausgangspunkt ist dabei John Gardners Artikel „The Opposite of Rape“, dessen zentrale These hinterfragt wird. Gardner argumentiert, dass die Auffassung von Sex als gemeinsame Handlung, oder wie er es bezeichnet, teamwork, zwangsläufig zu einer Ablehnung des Konzepts des sexuellen consent führt. Um dies zu widerlegen, analysiert der erste Teil der Arbeit zentrale Elemente von Gardners These, dass guter Sex teamwork ist, und vergleicht diese mit etablierten Theorien der gemeinsamen Handlung, darunter die von Margaret Gilbert, John Searle, David Velleman und Michael Bratman. Der zweite Teil ordnet Gardners Verständnis von sexuellem consent in aktuelle Debatten ein. Der dritte Teil entwickelt auf Grundlage von Gardners Kritik eine Neudefinition von sexuellem consent. Diese Arbeit zeigt, dass sowohl Gardners Konzept von Sex als teamwork als auch Theorien gemeinsamer Handlung nicht ausreichen, um Sex als gemeinsame Handlung zu erfassen. Während Gardners Ansatz theoretische Lücken aufweist, scheitern etablierte Theorien gemeinsamer Handlung daran, Spontanität, welche ein zentrales Merkmal von Sex ist, angemessen zu berücksichtigen. Dennoch bietet die Betrachtung von Sex als gemeinsame Handlung wertvolle Erkenntnisse über die Grenzen des traditionellen Verständnisses von consent. Anstatt Gardners Ablehnung von «consent» anzunehmen, plädiert diese Arbeit für eine Neudefinition von sexuellem consent. Sie schlägt ein Modell vor, das auf Symmetrie basiert und sowohl einen mentalen Zustand der Übereinstimmung als auch performative Aspekte einbezieht.

This master’s thesis explores one of philosophy’s underexamined fields by adopting a novel perspective. It examines sex as a joint action and its implications for the concept of sexual consent. Drawing primarily on John Gardner’s article “The Opposite of Rape”, this thesis challenges his claim that conceptualizing sex as a joint action, or, as he describes it, teamwork, necessarily leads to a rejection of sexual consent. To do so, the first part analyzes key elements of Gardner’s idea of good sex as teamwork and compares them to established joint action theories, including those by Margaret Gilbert, John Searle, David Velleman, and Michael Bratman. The second part situates Gardner’s understanding of consent within contemporary debates on sexual consent. The third part proposes a redefinition of sexual consent based on Gardner’s critique. This thesis reveals that both Gardner’s idea of sex as teamwork and theories of joint action fall short of conceptualizing sex as a joint action. While Gardner’s framework contains theoretical gaps, established joint action theories fail to account for spontaneity, a key aspect of sex. However, exploring sex as a joint action provides valuable insights into the limitations of the traditional understanding of consent. Rather than following Gardner’s rejection of consent, this thesis argues for a redefinition of sexual consent. It proposes a model of sexual consent based on symmetry, referring to both a mental state of being in agreement with as well as introducing performative aspects.
