Diese Arbeit untersucht die sich wandelnde Rolle des internationalen Investitionsrechts beim Schutz von Investoren im globalen Banken- und Finanzsektor – einem Bereich, der durch regulatorische Komplexität, politische Sensibilität und systemische Bedeutung für jeden Staat geprägt ist. Im Mittelpunkt steht die Frage, wie Schiedsgerichte, insbesondere im Rahmen des ICSID-Systems, die Qualifikation finanzieller Vermögenswerte als geschützte Investitionen behandelt haben, einschließlich Instrumenten wie Staatsanleihen, Derivatevereinbarungen und anderen immateriellen Finanzprodukten. Darüber hinaus wird analysiert, wie zentrale vertragliche Schutzstandards – etwa der Grundsatz der fairen und gerechten Behandlung, der Schutz vor Enteignung, das Diskriminierungsverbot sowie die Rolle von sogenannten „Umbrella Clauses“– in Streitigkeiten über Investitionen im Finanzsektor ausgelegt und angewandt werden. Die Untersuchung kombiniert eine dogmatische Rechtsanalyse mit einer detaillierten Betrachtung der Schiedspraxis und der Vertragspraxis und setzt sich zugleich mit der übergeordneten globalen Finanzarchitektur sowie den häufigsten Formen finanzieller Investitionen auseinander. Dieser Ansatz dient dazu, rechtliche Reaktionen in den Kontext der internationalen Finanzgovernance einzuordnen und ein vertieftes Verständnis der Finanzindustrie und ihrer besonderen Merkmale zu vermitteln. Dabei werden sowohl sich annähernde Argumentationsmuster der Schiedsgerichte als auch Bereiche fortbestehender Rechtsunsicherheit herausgearbeitet. Besonderes Augenmerk gilt den mit dieser Art von Investitionen verbundenen Risikofaktoren und der Frage, wie Schiedsgerichte während Finanzkrisen den Investitionsschutz mit dem souveränen Regulierungsrecht der Staaten in Einklang bringen. Durch die Analyse der besonderen Merkmale finanzieller Investitionen – wie ihrer vertraglichen Natur, regulatorischen Anfälligkeit, grenzüberschreitenden Mobilität und der spezifischen Strukturierung von Finanzinstrumenten – zeigt die Arbeit zudem, wie diese Elemente die Begründung von Schiedsentscheidungen in Investitionsverfahren beeinflussen. Abschließend werden die weitergehenden Auswirkungen auf Rechtssicherheit, Investorenvertrauen und Kapitalflüsse bewertet sowie Empfehlungen zur Investitionsstrukturierung, zur Weiterentwicklung von Investitionsverträgen und zur fortgesetzten, möglicherweise erweiterten Einbindung internationaler Finanzinstitutionen in die Unterstützung kohärenter und wirksamer Rechtsschutzmechanismen für Investoren in diesem Bereich gegeben.

This thesis explores the evolving role of international investment law in protecting investors in the global banking and finance sector, a field characterised by regulatory complexity, political sensitivity, and systemic importance for every state. It focuses on how arbitral tribunals, particularly under the ICSID framework, have addressed the qualification of financial assets as protected investments, including instruments such as sovereign bonds, derivative agreements, and other intangible financial products. It further examines how key treaty-based standards, such as fair and equitable treatment, protection against expropriation, non-discrimination, and the role of umbrella clauses are interpreted and applied in disputes involving financial sector investments. The research combines doctrinal legal analysis with a detailed examination of arbitral jurisprudence and treaty practice, while also engaging with the broader global financial architecture and the most frequent types of financial investments. This approach helps to contextualise legal responses within the realities of international financial governance and aims to present a better understanding of the financial industry and its unique characteristics. It highlights both converging tribunal approaches and areas of ongoing legal uncertainty. Special attention is given to the challenges of risk necessary for this kind of investment, and to how tribunals balance investor protection with the sovereign right to regulate during financial crises. By examining the distinctive features of financial investments, such as their contractual nature, regulatory exposure, cross-border mobility, and the specific structuring of financial instruments, the thesis also aims to show how these elements influence arbitral reasoning in investment arbitrations. It concludes by assessing the broader implications for legal certainty, investor confidence, and capital flows, and offers recommendations related to investment structuring, treaty development, and the continued, and potentially expanded, engagement of international financial institutions in supporting coherent and effective legal protections for investors in this field.
