Das Inkrafttreten des § 11b AVRAG im März 2024 hat im letzten Jahr die Frage nach der Kostentragung für Maßnahmen der Aus-, Fort- und Weiterbildung von AN in den Fokus des arbeitsrechtlichen Schrifttums gerückt. Wurde diese bislang mangels ausdrücklicher gesetzlicher Regelung in erster Linie mittels einer analogen Anwendung von § 1014 ABGB gelöst, ist mit § 11b AVRAG nunmehr in Umsetzung von Art 13 der Richtlinie (EU) 2019/1152 eine relativ zwingende Bestimmung in Kraft getreten, die die Kostentragung des AG für bestimmte Bildungsmaßnahmen explizit regelt. Ihre Auslegung ist jedoch in mehrfacher Hinsicht umstritten, nicht zuletzt wegen des starken Abweichens vom Wortlaut der Richtlinienbestimmung. Die vorliegende Arbeit zeichnet zunächst die Entwicklung der bisherigen Rsp des OGH zur Kostentragungspflicht des AG für Bildungsmaßnahmen des AN nach, bevor Art 13 der Richtlinie (EU) 2019/1152 und § 11b AVRAG sowie deren Unterschiede beleuchtet werden. Es folgt eine detaillierte Analyse der einzelnen Tatbestandselemente des § 11b AVRAG unter Berücksichtigung der divergierenden Argumente im Schrifttum. Abschließend wird der Frage nachgegangen, inwiefern im Anwendungsbereich des § 11b AVRAG noch die Möglichkeit zur Vereinbarung eines Ausbildungskostenrückersatzes nach § 2d AVRAG besteht.

In March 2024, Section 11b AVRAG (Austrian Employment Contract Law Adaptation Act) entered into force. This spared off renewed academic interest in the question of who bears the costs for employee education, training, and further qualification measures. Due to the absence of explicit statutory provisions, this subject had primarily been addressed through the analogous application of sec 1014 ABGB. With Section 11b AVRAG, however, a relatively binding provision implementing Article 13 of Directive (EU) 2019/1152 has now come into effect, which explicitly regulates the employer’s obligation to bear the costs of certain employee training and education measures. Its interpretation is controversial in several respects – not least due to its significant deviation from the wording of the Directive. This thesis will firstly delineate the development of the Austrian Supreme Court’s case law on employers’ obligations to cover costs for training and education measures, before examining Article 13 of Directive (EU) 2019/1152 and Section 11b AVRAG, along with the differences between these provisions. This will be followed by a detailed analysis of the individual elements of sec 11b AVRAG, taking into account the divergent positions in academic literature. Finally, the thesis examines whether it is still permissible to agree on the repayment of training costs under Section 2d AVRAG within the scope of application of Section 11b AVRAG.
