Diese Arbeit untersucht das kolumbianische Gesetz zum vorübergehenden Schutz venezolanischer Migranten (ETPV) als innovatives Rechtsinstrument zur Bewältigung der massiven Vertreibungskrise in Venezuela. Sie bewertet das Gesetz aus der Perspektive der internationalen Menschenrechtsgesetze und identifiziert drei wesentliche Mängel: das Fehlen besonderer Maßnahmen zur Gewährleistung der Gleichberechtigung in der Praxis, das Fehlen eines geschlechtsspezifischen Ansatzes und unzureichende Verfahrensgarantien. Unter Berufung vor allem auf die Rechtsprechung des Interamerikanischen Gerichtshofs für Menschenrechte sowie auf universelle und regionale Menschenrechtsverträge schlägt die Arbeit verschiedene Punkte zur Reform vor, um die vollständige Einhaltung der Menschenrechtsstandards zu gewährleisten. Sie kommt zu dem Schluss, dass das ETPV zwar innovativ und fortschrittlich ist, aber reformiert werden muss, um sein Potenzial als dauerhaftes Modell auf der Grundlage der besonderen Rechte von Migranten auszuschöpfen.

This thesis explores Colombia's Temporary Protection Statute for Venezuelan Migrants (ETPV) as an innovative legal tool to respond to the massive Venezuelan displacement crisis. It evaluates the statute from the perspective of international human rights law and identifies three main shortcomings: the lack of special measures to guarantee conditions of equality in practice, the absence of a gender-based approach, and insufficient procedural guarantees. Drawing primarily on the jurisprudence of the Inter-American Court of Human Rights, universal and regional human rights treaties, the thesis proposes key points for a reform to ensure full compliance with human rights standards. It concludes that the ETPV, while innovative and progressive, requires a reform to reach its potential as a lasting model based on the special rights of migrants.
