Das Verschwindenlassen im Kontext von Migration stellt ein wachsendes und dringendes menschenrechtliches Problem dar, das durch zunehmend gefährliche Migrationsrouten, restriktive staatliche Politiken und unzureichende internationale Koordinierung verschärft wird. Trotz verstärkter Dokumentation durch zivilgesellschaftliche Organisationen und internationale Überwachungsorgane bleiben Präventionsmaßnahmen fragmentiert und unzureichend. Diese Arbeit untersucht das Phänomen des Verschwindenlassens von Migrantinnen und Migranten und analysiert die entsprechenden völkerrechtlichen Verpflichtungen der Staaten, mit besonderem Schwerpunkt auf präventiven Pflichten. Auf Grundlage des internationalen Menschenrechtsschutzes, des internationalen Strafrechts, des Flüchtlingsrechts und des Migrationsrechts bewertet die Studie die Anwendbarkeit und Wirksamkeit bestehender Rechtsrahmen, einschließlich des Internationalen Übereinkommens zum Schutz aller Personen vor dem Verschwindenlassen. Darüber hinaus berücksichtigt sie die sich weiterentwickelnde Rechtsprechung und Auslegung internationaler Organe, regionaler Menschenrechtsgerichte sowie vertraglicher Überwachungsmechanismen.

Enforced disappearances in migration contexts represent a growing and urgent human rights concern, exacerbated by increasingly dangerous migration routes, restrictive state policies, and insufficient international coordination. Despite heightened documentation by civil society organizations and international monitoring bodies, prevention efforts remain fragmented and inadequate. This thesis examines the phenomenon of enforced disappearances affecting migrants and analyzes the corresponding obligations of States under international law, with particular emphasis on preventive duties. Drawing on international human rights law, international criminal law, refugee law, and migration law, the study evaluates the applicability and effectiveness of existing legal frameworks, including the International Convention for the Protection of All Persons from Enforced Disappearance. It further considers the evolving jurisprudence and interpretative guidance provided by international bodies, regional human rights courts, and treaty monitoring mechanisms.
