Die vorliegende Arbeit versucht die Frage zu beantworten, inwieweit die EU-Verfassung als Mythos und als ideologischer Text analysiert werden kann. Nach dem methodischen Konzept der theoretischen Praxis nach Althusser wird das Rechtsdokument textimmanent bearbeitet. Dabei kommen die ideologietheoreti-schen Werkzeuge von Marx/Engels, Gramsci und Althusser sowie die mythenana-lytischen Ansätze von Malinowski und Barthes zum Einsatz: Mit Hilfe von in einem ersten Schritt aus den Theorien explizierten Fragen wird die EU-Verfassung im zweiten Schritt auf ihren ideologischen und mythischen Gehalt abgeklopft.
Aus der theoretischen Praxis ergeben sich folgende zentrale Resultate: Die EU-Verfassung ist eine mythische Erzählung von oben – VertreterInnen von Nicht-Regierungsorganisationen, Gewerkschaften oder sozialen Bewegungen hatten auf ihren Entstehungsprozess wenig Einfluss. Auf ideologischer Ebene zeigt sich, dass vor allem die Partikularinteressen der Staats- und Regierungschefs und der bestehenden Exekutivorgane der Union (Rat und Kommission) durch die EU-Verfassung als Allgemeininteressen dargestellt werden. Die Hegemonieprodukti-on erfolgt über das ideologische Versprechen einer besseren gemeinsamen Zu-kunft für alle UnionsbürgerInnen, das unter anderem über abstrakte Demokratisie-rungs- und Partizipationsverheißungen konstituiert wird. Der Mythos Verfassung schafft – mit Barthes gesprochen – eine „Europäische Unionität“, deren wichtigs-tes Merkmal die Enthistorisierung ist – die Abwendung von der dunklen Vergan-genheit für die Prophezeiung einer hellen gemeinsamen Zukunft. Die ideologische Anrufung der Individuen als UnionsbürgerInnen erfolgt über eine spezifische „EU-Identität“, die verschiedene imaginäre Konzepte wie Demokratisie-rung/Partizipation, Wachstum/Fortschritt und universelle Werte wie Freiheit und Gleichheit einschließt. Diese EU-Identität kann von jedem/r UnionsbürgerIn un-terschiedlich interpretiert werden und bietet daher ein flexibles ideologisches Dach für alle, denen ein Platz im europäischen Haus zugestanden wird. Als rhetorische Grundform der ideologischen Anrufung im Rahmen der EU-Verfassung fungiert daher die Tautologie „wir sind wir“, die alle Nicht-UnionsbürgerInnen ausschließt.
Die Kombination der begrifflichen Werkzeuge von Ideologietheorie und Mythen-analyse lässt einen fruchtbaren Blick auf den Rechtstext und dessen immanente ideologischen und mythischen Mechanismen zu. Für eine genauere Analyse der Wirkung dieser Mechanismen müsste allerdings eine breitere empirische Untersu-chung angestellt werden, die die Rezeption der EU-Verfassung in unterschiedli-chen europäischen Ländern in den Fokus nimmt. Die vorliegende Arbeit kann auch als Vorbereitung und Anstoß für eine solche Studie verstanden werden.

The present paper attempts to answer the question to which extent the European Constitution could be analyzed as a myth and an ideological text. Following Al-thusser’s methodical concept of theoretical practice, a text-immanent approach has been chosen to deal with the legal document. In the process, both the ideo-logical-theoretical tools made available by Marx/Engels, Gramsci and Althusser and the myth-analyzing approach of Malinowski and Barthes are applied: As a first step, relevant questions were derived from the theories at hand and, conse-quently, these questions were used in a second step to explore the ideological and mythical contents of the European Constitution.
Theoretical practice yields the following central results: The European Constitu-tion is a mythic narrative from on high – representatives of non-governmental or-ganizations, unions or social movements had very little influence on its develop-ing process. At the ideological level, it becomes clear that individual interests of heads of states and governments and the Union’s executive powers (Council and Commission) are presented as common interests of all the Union’s citizens. The production of hegemony is executed as an ideological promise of a better common future for all the Union’s citizens, which – inter alia – is being constituted via ab-stract democratization and participation promises. Speaking with Barthes, the Constitution myth creates a “European Unionity”, the fundamental characteristic of which is de-historization – departure from a dark past for the prediction of a bright common future. The ideological invocation of individuals as citizens of the Union is effected through a specific “EU-Identity” which includes various imagi-nary concepts such as democratization/participation, economical growth/development and universal values such as freedom and equality. This EU-identity can be interpreted in varying ways by each EU-citizen, thereby offering a flexible ideological roof for all those who are granted a place in the European house. As the basic rhetoric form of the ideological invocation within the Euro-pean Constitution the tautology “we are we” is used which excludes all non-Union citizens.
Combination of the conceptual tools of ideological theory and myth analysis per-mits a copious view at the legal text and its immanent ideological and mythical mechanisms. For a more detailed impact analysis of these mechanisms, wider em-pirical research would be necessary, especially taking into focus the reception of the EU-Constitution in various European countries. The present paper could also be understood as a preparation and impulse for further research.
